2. What this policy covers

This Privacy Policy applies to:

  • Visitors to our websites (including www.fyndlink.com and our network platform);
  • Publishers (affiliates) who promote offers and use our tracking and reporting;
  • Advertisers who run campaigns and offers through our network;
  • Anyone who contacts us (e.g. via contact form or email).

We operate a multi-tier affiliate network that aggregates CPA, CPS and CPC programs. Data may be processed by us and by underlying networks or partners in accordance with their respective policies and agreements.

3. Data we collect and purposes

3.1 Website and contact

When you visit our websites we may collect: IP address, browser type and version, device information, referring URL, pages visited and approximate time of access. We use this to provide the site, ensure security, analyse usage and improve our services. Legal basis: legitimate interest (Art. 6(1)(f) GDPR).

When you use the contact form or email us we process: name, email address, subject and message content, and any other details you provide. We use this to respond to your request and, where relevant, to manage our business relationship. Legal basis: performance of pre-contractual or contractual steps, or legitimate interest in answering enquiries (Art. 6(1)(b) or (f) GDPR).

3.2 Publisher and advertiser accounts

When you register and use the Network as a publisher or advertiser we collect: account and profile data (e.g. name, email, company name, address, payment and tax details), login and usage data, and data related to your campaigns, traffic and conversions. We use this to operate the platform, provide tracking and reporting, process payments, prevent fraud, enforce our terms and comply with legal obligations. Legal basis: contract performance (Art. 6(1)(b) GDPR), legal obligation (Art. 6(1)(c) GDPR), and legitimate interest (Art. 6(1)(f) GDPR) for security, fraud prevention and improvement of services.

3.3 Tracking and conversion data

In the context of affiliate and performance marketing we and our partners use tracking technologies (including cookies, pixels and server logs) to attribute clicks and conversions to publishers, to prevent fraud and to optimise campaigns. This may involve: click and conversion identifiers, IP address, referrer, device and browser data, and timestamps. Such data may be shared with advertisers and underlying networks as necessary to operate the programs. Legal basis: contract performance and legitimate interest (Art. 6(1)(b) and (f) GDPR). Where cookies or similar technologies are used for non-essential purposes, we rely on your consent where required by law (see our Cookie Policy).

3.4 Marketing and newsletters

If you opt in to marketing or newsletters we use your email and preferences to send you relevant information about our services. You can unsubscribe at any time. Legal basis: consent (Art. 6(1)(a) GDPR).

4. Recipients and international transfers

We may share data with:

  • Underlying affiliate or performance networks and advertisers, to the extent necessary to run programs and attribute conversions;
  • Service providers (hosting, email, analytics, payment processors) who process data on our instructions;
  • Public authorities where required by law.

Some recipients may be in countries outside the European Economic Area (EEA). We ensure appropriate safeguards (e.g. standard contractual clauses or adequacy decisions) where required by data protection law.

5. Retention

We retain personal data only as long as necessary for the purposes set out above: e.g. for the duration of the contract and for a period thereafter to comply with legal obligations (e.g. tax and commercial law), resolve disputes and enforce our terms. Log and tracking data may be kept for a limited period for security and fraud prevention. Contact and marketing data are retained in line with consent and legitimate interest.

6. Your rights

Under the GDPR you have the right to:

  • Access – obtain confirmation as to whether we process your data and a copy of that data;
  • Rectification – have inaccurate data corrected;
  • Erasure – request deletion of your data where the legal grounds apply;
  • Restriction – request restriction of processing in certain cases;
  • Data portability – receive your data in a structured, commonly used format where the processing is based on contract or consent;
  • Object – object to processing based on legitimate interest, including profiling;
  • Withdraw consent – where processing is based on consent, withdrawal does not affect the lawfulness of processing before withdrawal.

To exercise these rights please contact us at support@fyndlink.com. You also have the right to lodge a complaint with a supervisory authority (e.g. the Berlin data protection authority if you are in Germany).

7. Security

We implement appropriate technical and organisational measures to protect your data against unauthorised access, loss or alteration. Access to personal data is restricted to those who need it for the purposes described. No transmission over the internet is completely secure; we encourage you to use strong passwords and keep your account details safe.

8. Children

Our services are not directed at minors. We do not knowingly collect data from children under 16. If you believe we have collected such data please contact us and we will delete it.
